Upham Sentenced After No Contest Plea to DUI


Lina Upham, Purchasing and Risk Manager/Deputy City Clerk for the City of Marco Island, appeared in Collier County Court on October 8 for a jury trial. Charged with a first offense DUI misdemeanor, Upham was adjudicated guilty after entering a plea of no contest.

Upham was fined $1,000 and sentenced to 12 months of probation with additional conditions, including: payment of prosecution and court costs; driver license revocation for 12 months; vehicle impounded for 10 days; 50 hours of community service; DUI school, victim impact panel; random breathalyzer tests; restrictions from drinking, entering bars, or having alcoholic beverages in her residence.

Upham was arrested on July 7 after she crossed over the median on Collier Boulevard into oncoming traffic, striking mangroves and partially submerging her vehicle in water. Her blood alcohol level was tested at .318. Florida drunk driving laws prohibit operating a vehicle at a Blood Alcohol Concentration of .08 and above.
