At the recent Marco Island City Council meeting, the issue of waiving the prohibition of construction work on Sundays was proposed. The prohibition, in effect since incorporation, was enacted to insure that residents have one day a week free from construction noise.
On September 10, 2017, Hurricane Irma made landfall on Marco Island, causing considerable damage to single family homes, condos and commercial properties. Prompt and successful debris removal and infrastructure repairs allowed the island to reopen for “season.”
But a quick ride around the island gives a stark reminder that there is much left to do. Although many of the structures have been dried in, as evidenced by the blue tarps on roofs, the work to replace many of those roofs is ongoing, for both single family homes and condominium associations.
During the meeting, Marco Island City Council agreed that the regulation on Sunday work should be lifted. Following Hurricane Irma, city council agreed to waive permitting fees for hurricane repairs. Eleven months later, council would agree to lift the regulation that banned Sunday construction for the same work for which those permits were issued.
Councilor Howard Reed discussed whether allowing Sunday construction would be a wise decision, citing safety concerns. “These guys are already working six days a week, between 10-12 hours a day. When you get that exhausted you make mistakes.”
Councilor Charlette Roman questioned what would be accomplished by lifting the regulation. “No citizen or contractors have reached out to me regarding this,” said Roman. “I have received citizens’ comments regarding the increase in noise and potential quality of life issues,” continued Roman.
It was unclear whether this change would affect condominium associations. Associations have their own restrictions and governing documents that address construction issues (although many may relax their regulations during the off-season to facilitate projects by owners, as well as work being done by the associations themselves).
In a 5-2 vote, council relaxed the regulation banning construction on Sunday, with both Councilors Roman and Reed voting against.
Construction on Marco Island is now allowed between noon and 5 PM on Sundays.
