PRESS RELEASE ON BEHALF OF MARCO ISLAND COMMUNITY AFFAIRS DIRECTOR, BRYAN MILK THROUGH HIS LEGAL COUNSEL, DOUGLAS E. SPIEGEL, ESQ.

It is with great disappointment and disbelief how the Marco City Council, at the hands of Larry Sacher, have afforded the Community Affairs Director Bryan Milk, a 15 year City Employee, ZERO DUE PROCESS.

The unilateral archaic commands at the helm of Sacher have deprived Bryan Milk of any and all due process and any other constitutional right one might have living in the 21st Century.

Mr. Bryan Milk has only first learned of his supposed fate of being terminated through an article that appeared in the Marco News on Friday, January 3rd, 2014.

It should be noted that the Interim City Manager, Guillermo Polanco requested Mr. Milk’s presence for a meeting at 2 p.m. on 12/31 through his secretary. Mr. Milk was not feeling well, which was known by his fellow employees. Mr. Milk had left work prior to what he believed was a routine meeting, which commonly took place 1-2 times a day between him and Polanco. At 2:07 p.m., an email was generated by Polanco {enclosed). Milk saw a physician and was diagnosed with bronchitis.

I would like to take a moment to clarify and expound on what is exactly at issue, since no one from the City Council of Marco has taken those steps,to at least inform the people of Marco, whom they work for.

Mr. Milk did at one time have a relationship with Progressive Auto’s Xpress Mart. It has been alluded to that perhaps they benefited from an interpretation that was conducted by Community Affairs Director Bryan Milk. Our response is absolutely not! Bryan Milk did provide an interpretation,at the request of Attorney Douglas Lewis. What the people should know is that this interpretation was written by Joe Irvin, the Zoning Administrator. It was further reviewed by Bryan Milk, Community Affairs Director and Burt Saunders, Attorney for the Marco City Council. Attorney Saunders reviewed the interpretation for sufficiency and form and acknowledged that he supported the findings written by Irving and signed by Milk.

This dog and pony show orchestrated by City Councilman Larry Sacher and Amadeo Petricca is nothing more than them wanting to get rid of an honest, dedicated,hardworking, 15 year
City Employee who wouldn’t submit to their, “good old boy network”.

So where did values and integrity get Community Affairs Director Bryan Milk? Well on 12/31/13 it supposedly got him suspended without pay, pending an internal investigation, per Interim City Manager Guillermo Polanco.

Who conducted this internal investigation? What was at issue in this investigation? Did anyone want to speak with Bryan Milk?

The paper quoted Polanco as stating the following on Friday, January 03,2014,”Polanco cited his continued efforts to reach out to Milk and his refusal to return those calls as
insubordination”. This is unequivocally false and Polanco should be ashamed of such callous mistruths. My client, Mr. Bryan Milk, has received zero correspondence from Polanco, other than the 12/31 email. My client has only been informed of his supposed termination by the article in the newspaper on 1/3/14.

Apparently Polanco is nothing more than a puppet at the hands of the puppeteer, Larry Sacher. This current City Council has aligned themselves as a black cloud over the people of Marco Island.

We will explore every available legal option available to Bryan Milk as a result of the alleged illegalities brought about by several members of the Marco City Council. Mr. Bryan Milk shall and will be afforded the Due Process that he is owed as well as each and every one of us who resides inthis great State! The Marco City Council does not have the right to act as Judge, Jury and Executioner, as they clearly havein this matter.
